PcX Terms and Conditions
PcX Basics
PcX is The Permaculture Crossing, an online Permaculture community sponsored and administered by the Association for Regenerative Culture (ARC) and the Permaculture Institute of North America (PINA).
PcX is built on the Mighty Networks platform. For more information about platform capabilities and use, please consult the Mighty Networks documentation (with the caveat that not all features described there may be available on PcX).
Information and policies below apply specifically to PcX.
Paid Subscriptions
Paid subscriptions are for premium spaces for which you will charge a fee. These might include spaces for consulting, for groups with restricted membership, and course spaces. All subscription tiers include initial space set-up, pricing plan set-up (if you choose to use our internal system to collect fees), access to online documentation, and up to 2 hours of support per month via email, chat, or Zoom session.
For spaces for which you plan to charge, you can use your own external payment system (taking payments yourself, then granting access to the space following payment). OR we can set up internal payment plans for your spaces. Payments will flow through our bank then to you via electronic payment to your bank. Note that payments may take up to a week to reach you (the first payment may take a bit longer), and we will deduct an 8% fee per transaction to offset processing costs. We also require your banking information.
We offer monthly plans for your convenience, though annual subscriptions save you 20% or more over the monthly rate. Our not-for-profit goal is to support and further permaculture education and the regenerative culture movement. Therefore ALL our plans are significantly less expensive than the cost of your own Mighty Network or similar platform, and also less expensive than other hosted solutions. And it’s likely that your students are already members of our growing community!
What we provide with paid subscriptions:
- an easy-to-use platform for creating and delivering your courses
- within 48 hours of receipt of your subscription, we will create 1 space. Subscriber will have “host”-level permissions to configure the site to meet your needs
- creation of additional spaces (in accordance with your Plan) within 72 hours of your request
- 24/7 access to documentation about all aspects of creating and maintaining a course or other space in MN
- up to 2 hours of support/month. This is consulting time with PcX staff via email, chat, or live video session.
Terms of Use for Space Hosts
By purchasing a subscription for PcX spaces, you agree to abide by the following Space Host Terms (“Terms”). As a Space Host, you are contracting with The Association for Regenerative Culture (“ARC”), a North Carolina nonprofit corporation.
1. PcX Space Host Responsibilities
As a PcX Space Host (“Host”) you are responsible for all content you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements ("Submitted Content"). PcX Space Hosts, like all PcX members, are subject to our Community Conduct Guidelines.
You represent and warrant that:
- you will maintain accurate account information;
- you own or have the required licenses, right, consents, and permissions for Submitted Content;
- you authorize PcX, ARC, and PINA to use your Submitted Content as specified herein;
- for courses and consulting, you have the required qualifications to teach and offer services you offer through your PcX Spaces;
You warrant that you will not:
- post or provide any inappropriate, false, misleading, incorrect, infringing, defamatory, or libelous content or information;
- post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation not related to your content and services;
- engage in any activity that would require us to obtain licenses from or pay royalties to any third party, including the need to pay royalties for the public performance of a musical work or sound recording.
2. License to PcX
You grant PcX, ARC, PINA and any sublicensed third parties the rights to offer and market your Submitted Content. This includes the right to modify your content to ensure accessibility for users with disabilities..
You grant PcX, ARC, PINA, and any sublicensed third parties the rights to record and use a portion of your Submitted Content for quality control and for marketing, promoting, or demonstrating PcX.
You retain non-exclusive rights to all Submitted Content and have the right to remove all or any portion of your Submitted Content.
For Submitted Content for which users pay a subscription, tuition, or fee, you will include a statement releasing PcX from any liability for requests for reimbursements or refunds. For example, “I [and/or your company] release from liability and agree not to sue PcX, ARC, PINA, nor their staff and board members for damages resulting from use of the PcX platform and integrated systems and/or services.”
3. Pricing
You are responsible for setting pricing for your offerings through your Spaces and for your Submitted Content. As mentioned above, we require that you clearly state that all subscriptions, tuition, or fees are paid to you directly and not to PcX, ARC, or PINA.
4. Payments
We encourage Space Hosts to direct subscribers to their Spaces through their own payment system. However, we do offer the use of PcX’s built-in payment system. For Space Hosts who choose to use our system, we require bank information for ACH transfers and will apply a 3% processing fee.
5. Trademarks
Upon request, we will provide Space Hosts with PcX logo images for promotion of your offerings/Submitted Content. We reserve the right to request changes to any written description of PcX, and you must comply with PcX requests to discontinue or take down any materials we deem misleading or inappropriate.
You may not use our logo or written description in misleading or disparaging ways or in ways that imply that we endorse, sponsor, or approve of your Submitted Content. You may not use our logo or written description in ways that violate applicable laws.
6. Content Deletion and Retention
PcX requires that you inform us (through any PcX administrator or an email to support@arculture.org) and all Space members 30 days in advance of deletion or removal of your content.
If PcX deems that you have abandoned your content and/or if you default on PcX subscription payments, we reserve the right to delete your Submitted Content and/or make it inaccessible, following reasonable attempts to contact you.
